What Is Online Gambling Regulation and Why Does It Exist?

I have been sober from gambling for eight years. I have written about it, taught about it, spent time in recovery programs. The question I still wrestle with is not whether gambling should be regulated. It is whether regulation can prevent what happened to me.

Online gambling regulation exists because unregulated online gambling proved catastrophic. In the late nineties, the internet created a space where gambling could happen without borders, without licenses, without consequences. A person in the US could gamble on a website registered in Antigua. If they lost money, they had no recourse. If the website disappeared, the money was gone.

Regulation created licensing systems. Malta Gaming Authority licenses operators. The UKGC licenses operators. Curaçao licenses operators. Each operator who wants to legally serve players in a jurisdiction applies for a license. If approved, the operator must follow the jurisdiction's rules. The operator must maintain minimum standards for player protection. The operator must segregate player funds. The operator must submit to audits.

What regulation cannot do is prevent the person it is trying to protect from being determined enough to bypass it. I bypassed it for a decade. I found unlicensed sites. I figured out how to use crypto to fund accounts that could not be tracked. I used multiple browsers and fake identities. The regulation was there. I just did not want to acknowledge it.

Why Regulation Failed for Me Specifically

Regulation works for people who do not want to gamble but are vulnerable to gamblin. Deposit limits, loss limits, self-exclusion programs. These tools work if the person using them is trying. I was not trying. I wanted to gamble. The regulation existed to prevent me from gambling, and I did not care. So I went around it.

Here is what regulation actually accomplishes:

Regulation prevents casual players from accidentally becoming problem gamblers through exposure to predatory sites. A casual player in the UK playing at a regulated casino has protections. Deposit limits are available. KYC verification means the player cannot hide money they are losing. The regulation works for the person who wants to protect themselves if they start losing.

  • For the person with active addiction, regulation is merely an obstacle to overcome. It does not cure the addiction.
  • Regulation protects everyone except the person who is already committed to the behavior.
  • Self-exclusion programs work only if the person enrolling in them actually wants to be excluded.
  • My exclusion from UK casinos did not stop me. It just moved me to crypto casinos and unregulated sites.

I spent eight years thinking regulation was failing. Now I understand regulation was not failing. I was failing. The regulation was designed to protect people from themselves. I did not want protection. I wanted to gamble. The strength of that wanting was stronger than any regulation could address.

The value of regulation is not to save people like me. It is to protect everyone else. A person new to gambling who plays at a regulated casino has a better experience than someone playing on an unregulated site. The regulated casino's margins are lower because they are transparent. The unregulated site can offer better odds because they can cheat you and you have no recourse. Regulation levels the field.

I do not believe regulation would have stopped my behavior. I do believe regulation made the problem slightly harder for other people, which is something. The people coming to online gambling now, they have a better chance of playing responsibly because the sites they play on have regulatory oversight. That is what regulation is for. Not to save people with active addiction. To protect everyone else.
